Position(s): Partner, McMillan & Co. Toronto, Canada Experience: Partner in the Competition and International Trade Groups. Member of the firm's Board of Partners, 2001–2007. Competition law practice - covers merger clearances under the Competition Act and foreign investment reviews under the Investment Canada Act; advising on marketing, distribution, grey marketing and joint venture issues; representing companies in cartel, abuse of dominance and other competition law proceedings; and submissions to governments on competition policy issues. Represented defendants in cartel investigations / class actions involving vitamins, rubber chemicals and related products, shipping, paper products, air cargo, chocolate confectionary, gasoline, automotive electrical components, optical disk drives and various other products. Counsel to targets and complainants in several non-public abuse of dominance inquiries by the Competition Bureau including two cases involving intellectual property rights. Submissions on behalf of the Competition Policy Group and the Merger Streamlining Group to Canadian and international government agencies regarding merger and other competition policy issues Trade law practice – includes anti-dumping and subsidy proceedings; NAFTA, WTO and Canadian Internal Trade Agreement matters; export / import controls and trade sanctions; foreign corrupt practices; investor-state disputes under NAFTA and bilateral investment treaties; and lobbying on trade policy issues Counsel to Canadian corn producers in anti-dumping and countervailing duty proceedings against subsidized US grain corn import. Represented parties with interests in the venetian blinds, fasteners, laminated flooring, appliances, bacterialogical culture media and bicycles anti-dumping and/or countervailing duty proceedings. Acted for the automotive industry in the Ethyl (MMT) case (including NAFTA Chapter 11 and Internal Trade Agreement issues). Counsel to parties in three cases involving notifications under the Foreign Extraterritorial Measures Act relating to U.S. restrictions on trade with Cuba. Industry expertise - worked on cases in most industries with particular emphasis on financial services, energy and natural resources, media and entertainment, technology, pharmaceuticals and chemicals, transportation, food and beverage, and other consumer products.
